These Terms of Service ("Terms") govern your access to and use of the VYBR Android app and this website (together, the "Service"). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be old enough to form a binding contract in your jurisdiction and meet the minimum age described in our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
2. Your account
You may use the Service as a guest or by creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it up to date.
3. Music content & third-party sources
Music metadata and audio made available through VYBR are provided via third-party sources. Catalogue metadata is retrieved from Spotify's catalogue through our UME backend, and audio streams are resolved via YouTube Music. VYBR does not own this content and does not maintain a duplicate music catalogue. Availability of any track, artist, album or playlist may change or become unavailable at any time without notice, and is subject to the terms and policies of those third parties.
4. Offline downloads — private use only
Where offered, offline downloads are provided solely for your personal, private, non-commercial use. You agree not to copy, redistribute, publicly perform, broadcast, sell, sublicense or otherwise make downloaded content available to others, and not to circumvent any technical limitations. Downloaded content may expire or require periodic re-validation.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any third-party rights.
- Reverse engineer, decompile, scrape, or attempt to extract source code or underlying data, except as permitted by law.
- Interfere with, disrupt, or overload the Service or its infrastructure.
- Circumvent content protections, rate limits, or access controls.
- Use automated means to access the Service without our permission.
6. Intellectual property
The VYBR name, logo, app design and original software are owned by us or our licensors and are protected by applicable laws. These Terms do not grant you any rights in third-party content, which remains the property of its respective owners.
7. Service changes & availability
We may add, modify, suspend or discontinue any part of the Service at any time. We do not guarantee that the Service will be uninterrupted, error-free, or that any particular content will remain available.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, VYBR and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, revenue or profits, arising from or related to your use of the Service.
10. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time and request deletion of your account as described in our Privacy Policy.
11. Governing law
These Terms are governed by the laws of the jurisdiction to be specified by VYBR upon legal review, without regard to conflict-of-laws principles.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
